Assault and Battery
Assault and Battery
Â
Charge: assault and battery on V. At trial, D takes the stand and denies the assault.
(1) D calls W to testify that he is familiar with D's reputation for truth and veracity and that D's reputation is good. On the prosecution's objection, what ruling and why?
(2) W is asked to testify as to D's reputation for peace and quietude. On the prosecution's objection, what ruling and why?
(3) In rebuttal the prosecution shows that D was convicted of grand larceny nine years ago. In surrebuttal D recalls W and puts the same question to him as in (1) about D's reputation for truth and veracity. On the prosecution's objection, what ruling and why?
