(1) Action against D Insurance Company to recover on a life insurance policy on Howard's life. The policy expired midnight May 31. Howard's death occurred the week of May 31, but there is a disputed issue of fact as to whether death occurred prior to or after May 31. At trial, P calls White to testify that on the afternoon of May 31 he saw the doorway to Howard's house hung with black crepe and bedecked with white lilies.

(2) At trial, P calls Weir to testify that he saw Dr. Munroe, Howard's attending physician, examine Howard on May 31 and then pull the bed sheet up over Howard's head.
