The Briefcase
Charge: Unlawful possession of a proscribed substance, to wit, marijuana. At D's trial, the prosecution offers into evidence a briefcase found by the police at D's office. According to the testifying officer, the briefcase contained more than one kilogram of marijuana. D works at the Acme Insurance Company. His office is a large open room with no dividers in which 25 people work at computer workstations. The only other evidence to link the briefcase to the defendant is the monogram on the briefcase consisting of the letters "WGM." The defendant's name is William G. Mellon. D objects to the introduction of the briefcase with the monogram on grounds of hearsay. What ruling and why?
