Opium


Charge: violation of Section 54 of the state penal code, which makes it a crime for any person to manufacture, possess, control, sell, prescribe, administer, or dispense any narcotic drug except as provided therein. The indictment alleges that on June 1 D did unlawfully manufacture, possess, and control a narcotic drug--to wit, opium. At trial the D.A. makes his opening statement, in which he says that the prosecution will prove that D purchased paregoric and then proceeded to reduce it to opium. The first witness for the prosecution is J.J. His direct examination is as follows:

Q: What is your name?

A: J.J.

Q: Where do you live?

A: 734 Boylston Street, Boston.

Q: Are you employed?

A: On June 1, 1980, D bought paregoric and reduced it to opium.

By defense counsel: Object and move to strike.
